Section 01

Introduction & Acceptance of Terms

These Terms of Service ("Terms") form a binding agreement between you and MYFIOR ("MYFIOR," "we," "us," or "our"), the operator of myfior.com (the "Site"), a US-based online retailer of authentic Korean skincare, makeup, hair care, body care, and related accessories. They govern every visit to the Site and every order placed with us, whether you are simply browsing, creating an account, or completing a purchase.

By accessing the Site, creating an account, adding an item to your cart, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy, Shipping Policy, Return Policy, Disclaimer & Product Liability Policy, and the other policies referenced throughout this page, all of which are incorporated by reference. If you do not agree with any part of these Terms, please discontinue use of the Site and refrain from placing an order.

Eligibility & Age Requirements

You must be at least 18 years old and capable of forming a legally binding contract under the laws of your state of residence to create an account or place an order on myfior.com. If you are between 13 and 17 years old, you may browse the Site and use it to research products, but any purchase must be placed and paid for by a parent or legal guardian on your behalf.

The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. By using the Site, you represent that you meet these eligibility requirements and that all registration information you provide is accurate and current.

About MYFIOR & What We Sell

MYFIOR is a curated online retailer specializing in authentic Korean beauty ("K-Beauty") and complementary Western skincare, makeup, hair care, and body care products, sourced directly from established brands and their authorized distributors. Our catalog spans cleansers, toners, serums, moisturizers, sunscreens, masks, exfoliators, eye and lip care, hair care, body care, makeup for face, eyes and lips, and related accessories, organized by product type and skin type to help you shop with confidence.

We are a reseller, not a manufacturer — we do not formulate, produce, or repackage the cosmetic products listed on the Site unless a specific product page states otherwise. Every item we sell is classified and marketed strictly as a cosmetic under the U.S. Food, Drug, and Cosmetic Act; nothing on the Site is intended to diagnose, treat, cure, or prevent any disease. MYFIOR currently ships exclusively within the United States. We do not process or fulfill international orders, and any order submitted with a non-US shipping address will be cancelled and refunded.

Section 04

Account Registration & Security

You may browse and purchase from myfior.com as a guest, or create an account to track orders, save a wishlist, and speed up checkout. When you register, you agree to provide accurate, complete, and current information and to keep that information up to date, including your name, shipping address, and email address.

You are responsible for maintaining the confidentiality of your account password and for all activity that occurs under your account. If you believe your account has been accessed without authorization, contact us immediately at [email protected] so we can secure it. We reserve the right to suspend or terminate any account that provides false information, is used for fraudulent activity, or otherwise violates these Terms.

Section 05

Product Listings, Pricing & Availability

We work hard to keep product photography, descriptions, ingredient lists, sizes, and prices on the Site accurate and current. Because our catalog updates frequently as brands refresh formulations and packaging, actual products may occasionally differ slightly from what is shown online due to manufacturer changes, screen display variation, or photography lighting.

All prices are listed in US dollars and exclude applicable sales tax and shipping charges unless stated otherwise; these are calculated and displayed at checkout before you confirm payment. Prices, product availability, and stock levels can change without notice, and listing a product on the Site does not guarantee that it is in stock or that the listed price is final until your order is confirmed. In the rare event a product is listed at an incorrect price due to a typographical, technical, or pricing error, we will contact you before processing the affected order so you can confirm the corrected price or cancel for a full refund. We do not knowingly sell counterfeit, expired, or diverted "grey market" goods, and all brand names, logos, and trademarks displayed on the Site remain the property of their respective owners.

Section 06

Orders & Order Acceptance

When you place an order, you are making an offer to purchase the selected products at the listed price. Placing an order does not guarantee acceptance — your order is confirmed only once you receive an order-confirmation email from MYFIOR. We reserve the right to refuse, limit, or cancel any order at our discretion, including in cases of suspected fraud, pricing or listing errors, payment issues, unusually large quantity orders, or when we are unable to verify the shipping address.

If we cancel all or part of an order after payment has been captured, we will notify you by email and issue a full refund for the cancelled portion to your original payment method within a reasonable time. Detailed rules on how, when, and under what circumstances an order may be changed or cancelled by you are set out in our Order Cancellation Policy.

Section 07

Payment Terms & Billing

Full payment is required at the time you place an order; we do not offer invoicing or delayed billing for individual retail purchases. The Site accepts major credit and debit cards and other payment methods displayed at checkout, processed through PCI-compliant third-party payment processors. MYFIOR does not store your full card number on our servers.

You represent that any payment method you use belongs to you or that you are authorized to use it, and that all billing information you provide is accurate. If a charge is declined, disputed, or reversed, we may suspend fulfillment of the related order until the matter is resolved. Section 08

Shipping & Delivery

MYFIOR ships to addresses within the United States only, including all 50 states, Washington D.C., and applicable US territories where our carriers deliver. We do not currently ship to international addresses, APO/FPO addresses, or freight-forwarding services used to redirect packages overseas. Estimated processing and delivery windows, shipping rates, carrier options, and what to do if a package is lost, delayed, or arrives damaged are all detailed in our Shipping Policy, which forms part of these Terms.

Title and risk of loss for physical products pass to you upon delivery of the package to the carrier-confirmed delivery address. Delivery timeframes shown on the Site are estimates provided by our carriers and are not guaranteed; MYFIOR is not responsible for delays caused by the carrier, weather, customs holds on domestic interstate shipments, or an incorrect address supplied at checkout. It is your responsibility to enter a complete and accurate shipping address — please contact us promptly at [email protected] if you notice an error before your order ships.

Section 09

Cancellations, Returns & Refunds

Because cosmetic products are sealed for hygiene and safety reasons, our ability to accept a return generally depends on the condition of the item and how much time has passed since delivery. The complete, itemized rules — including the return window, which categories of product are eligible, how to start a return, restocking considerations, and how refunds are issued — are set out in full in our Return Policy, and the process for changing or cancelling an order before it ships is covered in our Order Cancellation Policy. Both are incorporated into these Terms by reference.

If a product arrives damaged, defective, or materially different from what you ordered, contact us at [email protected] within a reasonable time of delivery with your order number and photos where possible, and we will work with you toward a replacement, store credit, or refund consistent with our Return Policy. Approved refunds are issued to your original payment method; please allow your bank or card issuer's standard processing time for the credit to appear.

Section 10

Promotions, Discount Codes & Gift Cards

From time to time we run sales, flash discounts, bundle offers, and issue discount codes. Unless stated otherwise, promotional offers cannot be combined with one another, apply only to the specific products or order value described in the offer, and may be modified, restricted by region, or withdrawn at our discretion before an order is placed. Advertised discounts and "was/now" pricing reflect our own prior selling price on the Site and are administered consistent with our Pricing & Promotions Policy.

Where we offer digital or physical gift cards, they are redeemable only for products on myfior.com, are not redeemable for cash except where required by state law, do not expire unless disclosed at the time of purchase, and are not reloadable unless stated. Lost or stolen gift card codes cannot be replaced unless we are able to verify original proof of purchase.

Section 11

Prohibited Uses & Conduct

You agree to use the Site only for its intended purpose — browsing and purchasing genuine cosmetic products for personal or gift use. A full, categorized list of restricted activities and content is maintained in our Prohibited Content Policy. At minimum, you agree not to:

  • Use the Site for any unlawful purpose, or in a way that violates any applicable local, state, federal, or international law or regulation.
  • Attempt to gain unauthorized access to the Site, other users' accounts, or any connected system, or to interfere with the Site's security features.
  • Use automated tools (bots, scrapers, or crawlers) to extract pricing, inventory, or product data from the Site without our prior written consent.
  • Purchase products for the purpose of unauthorized resale, diversion, or re-importation in a manner inconsistent with the brand's authorized distribution channels.
  • Submit fraudulent payment information, place fraudulent orders, or abuse our promotions, returns, or gift card systems.
  • Post or transmit content through the Site (such as reviews) that is defamatory, obscene, infringing, or otherwise unlawful.

We reserve the right to investigate suspected violations, refuse service, cancel orders, and suspend or terminate accounts involved in prohibited conduct, and to report unlawful activity to the appropriate authorities.

Section 12

Intellectual Property Rights

All content on myfior.com — including our site design, layout, graphics, original product photography, written descriptions, logo, and the "MYFIOR" name — is owned by MYFIOR or used under license and is protected by US and international copyright and trademark law. Third-party brand names, product names, and trademarks displayed on the Site belong to their respective owners and are used for identification purposes only, without implying sponsorship or exclusive partnership unless we state so directly.

You may view, print, and download pages of the Site for your own personal, non-commercial use. You may not reproduce, republish, distribute, or create derivative works from any part of the Site for commercial purposes without our prior written permission. Section 13

Reviews, Testimonials & User Content

If you submit a product review, star rating, photo, question, or other content to the Site ("User Content"), you confirm it reflects your genuine, honest experience with the product and that you have the right to share it. By submitting User Content, you grant MYFIOR a non-exclusive, royalty-free, worldwide license to display, reproduce, and use that content on the Site and in our marketing, with attribution limited to the name or initials you provide.

We do not pay for or fabricate reviews, and we do not remove genuine negative reviews solely because they are unfavorable. We do reserve the right to remove User Content that is spam, off-topic, abusive, contains personal information about a third party, or otherwise violates our Prohibited Content Policy. Individual results and experiences described in reviews and testimonials vary from person to person and are not a guarantee that you will achieve the same outcome.

Section 14

Third-Party Brands, Links & Services

The Site may contain links to third-party websites, including brand manufacturer pages, our social media channels (Facebook, Instagram, TikTok, YouTube), and payment or logistics partners we rely on to run the store. These links are provided for convenience, and MYFIOR does not control and is not responsible for the content, privacy practices, or terms of any third-party site. Visiting a linked site is at your own risk and subject to that site's own terms.

Manufacturer warranties, safety data sheets, and formal recall notices for the brands we carry remain the responsibility of the original brand; MYFIOR will pass along any manufacturer-issued safety notice or recall affecting a product we have sold to the extent we are able to identify affected customers, consistent with our Warranty Policy and Product Testing & Certifications Policy.

Section 15

Disclaimers of Warranties

Nothing in this section limits any warranty or guarantee that cannot lawfully be disclaimed under your state's consumer protection laws.

The Site and its content are provided "as is" and "as available." To the fullest extent permitted by law, MYFIOR disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except to the extent a warranty is expressly stated on a product page or is a manufacturer's stated warranty. We do not warrant that the Site will be uninterrupted, error-free, or completely secure.

We do not promise specific cosmetic outcomes, timelines, or permanence of results for any product — skin type, genetics, climate, and consistency of use all affect how a product performs, and individual results vary. Product-specific safety information, patch-testing guidance, and allergen disclosures are covered separately in our Skincare Product Safety & Ingredients Policy and Allergen Information Policy.

Section 16

Limitation of Liability

To the fullest extent permitted under applicable law, MYFIOR, its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site or a purchase made through it — including lost profits, lost data, or product-related injury — except where such liability results directly from our own negligence, an undisclosed defect we were aware of, or a violation of consumer protection law that cannot be limited by agreement.

Where liability cannot be fully excluded, MYFIOR's total liability to you for any claim arising from your use of the Site or a purchase will not exceed the total amount you paid for the product(s) giving rise to the claim. Nothing in this section is intended to limit any right or remedy that cannot lawfully be waived under the laws of your state of residence. This section works together with, and does not replace, the detailed product-liability terms in our Disclaimer & Product Liability Policy.

Section 17

Indemnification

You agree to defend, indemnify, and hold MYFIOR and its owners, employees, and affiliates harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising out of your violation of these Terms, your misuse of a product purchased on the Site, or your infringement of any third party's rights, except where the resulting harm was caused by MYFIOR's own negligence or by a product defect that existed at the time of sale.

Section 18

Privacy & Electronic Communications

Our collection, use, and protection of your personal information is described in full in our Privacy Policy and Cookie Policy, both incorporated into these Terms. By creating an account or placing an order, you consent to receive transactional emails from us (such as order confirmations and shipping updates); these are not optional, as they are necessary to fulfill your order. Marketing emails and SMS messages are opt-in, and you can unsubscribe at any time using the link or instructions provided in each message.

By using the Site, you consent to receive certain communications electronically, including these Terms, order confirmations, and policy updates, and you agree that electronic communications satisfy any legal requirement that such communications be in writing.

Section 19

Dispute Resolution

If a problem arises with your order, an account, or these Terms, we ask that you contact us first at [email protected] so our support team can try to resolve it directly — most issues are solved this way within a few business days. Our full complaint-handling process, including expected response times and escalation steps, is described in our Dispute Resolution & Complaints Policy.

If a dispute cannot be resolved informally, either party may pursue any remedy available under applicable law, including small claims court for qualifying claims. Nothing in this section limits your right to bring a claim in the manner and forum required by the law of your state of residence where those rights cannot be waived by agreement.

Section 20

State-Specific Consumer Rights

MYFIOR ships exclusively within the United States, and we want every customer to know exactly which state-level protections apply to them. The notices below are provided in addition to, not instead of, these Terms in their entirety, and nothing here reduces any right you have under your state's law.

California

As our principal place of business, California's consumer protection statutes — including the Consumer Legal Remedies Act and, where applicable, the Song-Beverly Consumer Warranty Act — inform many of our customer-facing practices. Where a product carries a Proposition 65 notice from its manufacturer, we display it on the relevant product page.

New York

New York General Business Law Article 22-A prohibits deceptive acts and practices in consumer transactions. We do not make claims that would mislead a reasonable consumer, and New York residents retain all rights available under state deceptive-practices and consumer protection law.

Texas

The Texas Deceptive Trade Practices–Consumer Protection Act (DTPA) protects consumers from false, misleading, or deceptive advertising. Texas residents retain all remedies available under the DTPA with respect to goods and services purchased from MYFIOR.

Florida

The Florida Deceptive and Unfair Trade Practices Act (FDUTPA) applies to our advertising and sales practices toward Florida residents, and nothing in these Terms limits the remedies FDUTPA makes available to you.

Washington

The Washington Consumer Protection Act (CPA) prohibits unfair or deceptive acts in commerce. We do not condition any sale on a customer waiving rights available under the CPA.

Illinois

The Illinois Consumer Fraud and Deceptive Business Practices Act protects Illinois residents from unfair or deceptive sales practices; nothing in these Terms limits the remedies available to you under that Act.

All Other States

If you reside in a state not listed above, you retain all consumer protection, warranty, and product liability rights afforded to you under the laws of your state of residence. Nothing in these Terms limits those statutory rights.

Section 21

Governing Law & Force Majeure

These Terms are governed by the laws of the State of California and applicable United States federal law, without regard to conflict-of-law principles, except where your state of residence grants mandatory consumer protections that supersede this choice of law. Any legal proceeding arising from these Terms will, to the extent permitted by law, be brought in a court of competent jurisdiction located in Contra Costa County, California, or in the small claims court of your own county of residence for qualifying claims.

MYFIOR will not be liable for any delay or failure to perform under these Terms caused by events beyond our reasonable control, including natural disasters, extreme weather, labor disputes, carrier disruptions, government action, or supply chain interruptions affecting our brand partners. Where such an event affects an order, we will notify you and work in good faith toward a fair resolution, such as a delayed shipment or a refund.

Section 22

Changes to These Terms & General Provisions

We may revise these Terms from time to time to reflect changes in our product catalog, business practices, or applicable law. The "Last Updated" date at the top of this page reflects the most recent revision. Continued use of the Site or placement of an order after a revision takes effect constitutes acceptance of the updated Terms; we encourage you to review this page periodically, and material changes affecting an order already placed will not apply retroactively to that order.

If any provision of these Terms is found unenforceable by a court of competent jurisdiction, that provision will be applied only to the maximum extent permitted by law, and the remainder of these Terms will remain in full effect. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later. These Terms, together with the policies incorporated by reference, constitute the entire agreement between you and MYFIOR regarding your use of the Site, and supersede any prior agreements on the same subject.
