Disclaimer & Product Liability Policy

A clear, complete account of how MYFIOR sources, describes, and stands behind every skincare and makeup product we sell — written so you always know exactly what to expect before you buy.

Section 01

Purpose of This Policy

This Disclaimer & Product Liability Policy explains, in plain language, the terms under which MYFIOR ("MYFIOR," "we," "us," or "our") makes skincare and makeup products available for sale on myfior.com (the "Site"). It sits alongside our Shipping Policy, Return Policy, and Privacy Policy, and is intended to give every visitor a complete, transparent picture of what our products are, what they are not, and how responsibility is shared between MYFIOR and the customer.

By browsing the Site or purchasing a product, you acknowledge that you have read, understood, and agree to the terms set out below. If any part of this policy is unclear, please contact us at [email protected] before placing an order.

Section 02

What MYFIOR Sells

MYFIOR is a US-based online retailer offering curated skincare, makeup, and body care products — including cleansers, toners, moisturizers, serums, sunscreens, masks, exfoliators, eye and lip care, and related accessories — sourced primarily from established international and domestic beauty brands. We are a retailer and reseller of finished, pre-manufactured cosmetic products; we do not manufacture, reformulate, or repackage the items we sell.

Every product listed on the Site is classified and sold strictly as a cosmetic, as that term is defined by the U.S. Food, Drug, and Cosmetic Act (FD&C Act) — meaning it is intended to cleanse, beautify, promote attractiveness, or alter the appearance of the skin, without affecting the body's structure or function in the manner of a drug.

Section 03

Not Medical, Dermatological, or Professional Advice

No product description, blog article, product review, or customer testimonial on this Site is intended to diagnose, treat, cure, or prevent any disease or medical condition.

All product descriptions, ingredient highlights, skin-type recommendations, and blog content published on myfior.com are provided for general informational and cosmetic purposes only. They do not constitute, and should never be treated as, medical, dermatological, or professional skincare advice. MYFIOR is not a licensed medical provider, dermatology clinic, or pharmacy, and no member of our team is qualified to assess your individual skin condition.

If you have a diagnosed skin condition (such as eczema, rosacea, psoriasis, or active acne requiring treatment), are recovering from a cosmetic procedure, or are otherwise uncertain whether a product is appropriate for you, please consult a board-certified dermatologist or physician before use. Nothing on this Site should delay or replace a consultation with a qualified healthcare professional.

Section 04

FDA & Federal Regulatory Compliance

MYFIOR takes federal cosmetic regulation seriously. All products offered on the Site are represented, marketed, and sold in a manner consistent with:

  • The Food, Drug, and Cosmetic Act (FD&C Act), which governs how cosmetics may be labeled, described, and sold in the United States.
  • The Modernization of Cosmetics Regulation Act of 2022 (MoCRA), which introduced facility registration, product listing, adverse-event reporting, and safety-substantiation requirements for cosmetic manufacturers and responsible persons.
  • The Fair Packaging and Labeling Act (FPLA), governing accurate net-content and ingredient labeling.
  • Federal Trade Commission (FTC) guidance on truthful advertising, substantiated claims, and endorsement/testimonial disclosures.

We do not list, describe, or advertise any product using drug claims, disease claims, or structure/function claims that would cause it to be regulated as an unapproved drug. Where a manufacturer's own packaging includes claims beyond cosmetic use, our product listings are edited to remove or qualify such language before publication. If you believe any listing on our Site contains a claim that overstates what a cosmetic product may legally do, please report it to [email protected] so we can review and correct it promptly.

Section 05

Patch Testing & Allergic Reactions

Cosmetic and skincare products contain active botanical, chemical, and fragrance ingredients that can trigger sensitivity, irritation, or allergic reaction in some individuals, even when a product is correctly manufactured and used as directed. We strongly recommend that every customer perform a 24–48 hour patch test on a small, discreet area of skin (such as the inner forearm) before applying any new product to the face or body.

Discontinue use immediately and rinse thoroughly with water if you experience redness, itching, burning, swelling, hives, or any other sign of irritation. If a reaction is severe or persistent, seek medical attention. MYFIOR is not able to predict or guarantee how any individual's skin will respond to a given product, and we are not liable for allergic or sensitivity reactions that occur despite a product being correctly labeled, undamaged, and used as intended.

Section 06

Ingredients, Sourcing & Transparency

Every product page on myfior.com lists the manufacturer-provided ingredient (INCI) list, country of origin where available, and relevant product details as supplied to us by the brand or our authorized distributors. We source products directly from the original brand or from vetted, authorized wholesale distributors, and we do not knowingly sell counterfeit, expired, or diverted "grey market" goods.

Because formulations are occasionally updated by manufacturers, we recommend always checking the physical packaging and ingredient list you receive against your personal allergen list before first use, particularly if you have a known sensitivity or are pregnant, nursing, or managing a medical condition. If a product arrives with an ingredient list that differs materially from what is shown on our Site, please contact us at [email protected] so we can investigate.

Section 07

Proper Use, Storage & Handling

To help every product perform as intended and to reduce the risk of irritation or spoilage, please:

  • Follow the directions for use printed on the product packaging, not solely the summary shown on our Site.
  • Store products away from direct sunlight and extreme heat, and keep containers tightly closed between uses.
  • Keep all products out of reach of children and pets, and avoid contact with eyes, mucous membranes, or broken skin unless a product is specifically labeled for that use.
  • Discontinue use of any product once it has passed its Period-After-Opening (PAO) symbol or expiration date, or if its color, texture, or smell has changed.
  • Discard, rather than resell or gift, any product that shows signs of contamination, separation, or packaging damage.
Section 08

Who Should Take Extra Care

Our products are formulated and marketed for general adult and adolescent cosmetic use and are intended for purchase by individuals who are 18 years of age or older, or by a parent or guardian purchasing on behalf of a minor. Certain categories carry additional considerations:

  • Pregnancy & nursing: Some active ingredients (such as certain retinoids, high-percentage exfoliating acids, and specific essential oils) are commonly advised against during pregnancy or while breastfeeding. If you are pregnant or nursing, please review the full ingredient list with your physician before use.
  • Sun-exposure products: Sunscreens and SPF-containing products should be reapplied as directed on the label and are not a substitute for shade, protective clothing, and other sun-safety measures.
  • Active treatment products: Exfoliating acids, retinol-based treatments, and similar products can increase skin sensitivity to sunlight; daytime sun protection is recommended whenever these are used.
Section 09

Individual Results May Vary

Skin type, genetics, climate, lifestyle, product combination, and consistency of use all affect how a cosmetic product performs. Any "before and after" imagery, customer testimonial, star rating, or performance description shown on our Site reflects individual experience and is not a guarantee that you will achieve the same or similar results. We do not promise specific cosmetic outcomes, timelines, or permanence of results for any product.

Section 10

Third-Party Brands & Trademarks

All brand names, product names, logos, and trademarks displayed on myfior.com — including the brands featured in our Skincare, Makeup, and Brands catalogs — are the property of their respective owners. MYFIOR is an independent authorized retailer and is not the manufacturer of these products unless explicitly stated otherwise on a specific product page. Reference to a brand or trademark on our Site is for identification purposes only and does not imply manufacture by, sponsorship by, or exclusive partnership with MYFIOR unless we state so directly.

Manufacturer warranties, safety data sheets, and formal recall notices, where applicable, remain the responsibility of the original brand. MYFIOR will pass along any manufacturer-issued safety notice or recall affecting a product we have sold to the extent we are able to identify affected customers.

Section 11

Website & Content Accuracy

We work to keep product photography, descriptions, ingredient lists, pricing, and availability on myfior.com accurate and current. However, images may differ slightly from packaging you receive due to manufacturer updates, screen display settings, or photography lighting, and occasional typographical or pricing errors may occur. In the event a listed price or description is materially incorrect, we will contact you before processing the affected order and you will have the option to confirm the corrected order or cancel it for a full refund.

Blog articles, buying guides, and skin-type quizzes published on the Site reflect general cosmetic industry knowledge at the time of writing and are provided for educational entertainment purposes; they are not continuously updated to reflect the latest dermatological research and should not be relied upon as a sole source of skincare guidance.

Section 12

Limitation of Liability

To the fullest extent permitted under applicable law, MYFIOR, its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to skin irritation, allergic reaction, lost enjoyment, or lost time — arising out of your purchase, receipt, or use of a product bought through myfior.com, except where such liability results directly from our own negligence, an undisclosed defect we were aware of, or a violation of applicable consumer protection law that cannot be limited by agreement.

Nothing in this policy is intended to limit any right or remedy that cannot lawfully be waived or limited under the laws of your state, including rights arising under state product liability and consumer protection statutes. Where a limitation described here is found unenforceable in your jurisdiction, that limitation will be applied only to the maximum extent permitted by law, and the remainder of this policy will remain in full effect.

Section 13

Indemnification

By purchasing from myfior.com, you agree to hold MYFIOR harmless from claims arising out of misuse of a product — for example, use contrary to label directions, use of an expired or visibly compromised product, failure to patch test before first use, or use by someone other than the intended purchaser without appropriate caution — except where the resulting harm was caused by MYFIOR's own negligence or by a product defect that existed at the time of sale.

Section 14

State-Specific Consumer Notices

MYFIOR ships exclusively within the United States. Because consumer protection and product liability standards vary by state, the notices below apply to residents of the states listed. These notices are provided in addition to, not instead of, this policy in its entirety.

California

Proposition 65: Some cosmetic products can expose users to trace chemicals known to the State of California to cause cancer or reproductive harm. Where a manufacturer provides a Prop 65 notice for a product, we display it on the relevant product page. As our principal place of business, California's consumer protection statutes (including the Song-Beverly Consumer Warranty Act, where applicable to goods sold) govern many of our customer-facing practices.

New York

New York General Business Law Article 22-A prohibits deceptive acts and practices in consumer transactions. We do not make cosmetic claims that would mislead a reasonable consumer, and New York residents retain all rights available under state deceptive-practices and product liability law.

Texas

The Texas Deceptive Trade Practices–Consumer Protection Act (DTPA) protects consumers from false, misleading, or deceptive advertising. Texas residents retain all remedies available under the DTPA and Texas products-liability law with respect to defective goods.

Florida

The Florida Deceptive and Unfair Trade Practices Act (FDUTPA) applies to our advertising and sales practices toward Florida residents, alongside Florida's strict-liability framework for defective consumer products.

Washington

The Washington Consumer Protection Act (CPA) prohibits unfair or deceptive acts in commerce. We do not condition any sale on a customer waiving rights available under the CPA.

All Other States

If you reside in a state not listed above, you retain all consumer protection, warranty, and product liability rights afforded to you under the laws of your state of residence. Nothing in this policy limits those statutory rights.

Section 15

Governing Law & Jurisdiction

This policy is governed by the laws of the State of California and applicable United States federal law, without regard to conflict-of-law principles, except where a customer's state of residence grants mandatory consumer protections that supersede this choice of law. Any dispute arising from a purchase made through myfior.com will first be addressed through direct communication with our support team at [email protected] before any formal proceeding is initiated.

Section 16

Updates to This Policy

We may revise this Disclaimer & Product Liability Policy from time to time to reflect changes in our product catalog, applicable law, or business practices. The "Last Updated" date at the top of this page reflects the most recent revision. Continued use of the Site or purchase of products after a revision takes effect constitutes acceptance of the updated policy. We encourage you to review this page periodically.
